There now is one less Uptown bar. Zachary"s, 30 N. Court Street, has been closed and eviction notices have been posted.
According to Athens County Municipal Court records, on June 27 the court found that Christopher Boyd, owner of Zachary"s, violated the lease agreement by failing to pay the $2,200 a month rent from January 2003 through April 2003. The court ruled that Zachary"s would have to pay the $8,800 in rent plus any other rent charges they did not pay. By June the total had reached $13,500. The court also ordered that Zachary"s was forced to leave the premise and the locks be changed.
Ken Smith, owner of Smith Rentals, which owns the building where Zachary"s was located, said the matter is now in the hands of the courts but as far as he was concerned Zachary"s was closed for good. William Walker, Smith"s attorney, could not comment further on the lawsuits.
According to a June 6 Postarticle, Boyd, who in August opened a new Zachary"s in Columbus, was ordered in May to pay more than $110,000 to Zanesville-based Unizan National Bank.
According to the same article, Smith said in a 1995 deposition that the Athens Zachary"s, having recently lost its deli option because of a broken refrigerator, was not meant to be a nightclub. Last year Boyd faced two other civil suits for failure to pay investor Dayton Data Processing and contracted partner Nauman Outdoor Advertising, and said that Zachary"s hired contractors who assured him no permit was necessary.
Smith brought Boyd to court in 1995 because Zachary"s violated the 1992 lease agreement by phasing out the restaurant/deli and installing a bar with cover charge and live bands every weekend, according to the article.
Boyd was contacted at his Columbus area Zachary"s, but did not comment.
