A Glouster man who pleaded guilty to aggravated robbery last January filed a motion for judicial release with the Athens County Common Pleas Court Tuesday. If granted, he would be released early from prison.
Anthony Carey, 33, pleaded guilty to an indictment charging one count of aggravated robbery and one count of burglary as part of an agreement with the Athens County Prosecutor’s Office on Jan. 30, 2013.
Because he was found guilty of robbing Jewell’s Carry-Out in Glouster, Carey was sentenced to four years in prison and was ordered to pay restitution in the amount of $545 to the store, according to court documents.
However, Athens County Prosecutor Keller Blackburn said an estimated $200 was taken from the carryout and drugs were the motive, according to a previous Post article.
Court documents filed Wednesday state that the victim, Jewell’s Carry-Out, should be notified of Carey’s motion.
Carey’s accomplices, Jason Johnson, 31, and Timothy Orsborne, 35, drove the getaway car and carried a .22 caliber handgun into the carryout store.
Johnson and Orsborne also accepted plea agreements, but because they pleaded guilty to more charges in their indictments, they were sentenced to 12 years and 16 years in prison, respectively, in early February 2013.
According to a previous Post article, Carey could have been sentenced to a maximum of 14 years in prison and a maximum fine of $13,000 as part of the agreement.
Carey is due back in court March 28 for a hearing regarding the motion.
