Baseball: Former player refiles negligence suit against university

A former Ohio baseball player has refiled a suit against the university, claiming that negligence from baseball coach Rob Smith resulted in permanent injury and the end of his baseball career. 

Though attorneys representing the university asked for the case to be dropped, a court date has been set for next summer. 

RyLee Rogers originally filed the lawsuit in October 2015, according to a previous Post report. He refiled the lawsuit in May. 

Rogers is still asking for $25,000, the same amount in his original lawsuit. 

The attorney representing Rogers, Orville Reed, didn’t respond to requests for comment. Rogers graduated from Ohio University in 2017. 

The former Ohio baseball player claims that he was one of multiple players to suffer shoulder or arm injuries and that, despite the injury, he was told by Smith to warm up pitchers. 

Rogers also claims that Smith criticized players who complained about injuries. 

The university responded to the lawsuit, saying that Smith was not negligent and that Rogers assumed the risk of injury. 

OU Spokesman James Sabin responded to a request for comment, but he said that the university doesn’t comment on pending litigation.
