Gates had been convicted of felonious assault in August.
A 24-year-old man found guilty in August of fourth-degree-felony assault appeared back in Athens County Common Pleas Court Monday afternoon after violating the terms of his sentence.
Common Pleas Court Judge L. Alan Goldsberry put Cory Gates on a diversion program at the time of his original conviction, requiring him to pay both diversion and court fees; community service was also mandatory, but Gates failed to log any hours or pay those fees.
On top of that, Gates had since been found guilty for two first-degree misdemeanors — child endangerment and domestic violence — in Athens County Municipal Court while on the program.
He pleaded guilty to those counts on Sept. 22 and was sentenced to 30 days in jail.
Prosecutors filed a notice terminating Gates’ diversion eligibility on Oct. 8.
Assistant Athens County Prosecutor Timothy Warren said Gates’ inability to pay court and diversion fees alone called for that termination.
Gates is scheduled to return to court Jan. 12, where he will then be sentenced.
