McDavis agrees to pay woman hit by OU bus double what she initially sought

It was an ordinary day two years ago when a Cincinnati woman was crossing a street when, all of a sudden, a Campus Area Transit Service bus struck her while she was in a crosswalk.

Samantha Reidy filed a complaint with the Ohio Court of Claims against Emily Keeley, who was behind the wheel of the Ohio University-owned CATS bus that struck Reidy on Sept. 13, 2011. Keeley was accused of negligent driving, and Reidy, according to court documents, requested at least $25,000 in damages.

However, the court settled the case Oct. 15, granting her $50,000, pursuant to the Ohio Revised Code, because of a proposed settlement offer the university submitted Oct. 7.

Reidy acquired several “serious injuries,” according to court documents, and intends to use the money for medical expenses.

Although the documents do not specify what Reidy’s physical injuries were, they state that “as a direct and proximate result of the conduct of Emily Keeley, Samantha Reidy has suffered a loss of enjoyment of life.”

In return for the money OU fronted her, Reidy agreed to drop all legal claims against OU.

Reidy signed off on the settlement along with her legal counsel Melancthon W. Chatfield. OU President Roderick McDavis and Ohio Asst. Attorney General Peter DeMarco, OU’s legal counsel, signed in agreement.

The case was officially dismissed after the settlement was accepted, and therefore cannot be re-opened.
